Terms of Service

These Terms of Service ("Terms") govern use of the Wheelie Hungry website and mobile application (together, the "Service"). The Service is operated by Wheelie Hungry, LLC ("Wheelie Hungry," "W.H.," or "Company").

By creating an account or accessing the Service, users agree to be bound by these Terms. These Terms apply to all parties utilizing the Service, including food truck vendors and customers.

The Terms may be updated periodically. Material changes will be communicated by posting the revised Terms within the Service or through other appropriate means. Continued use of the Service after such changes constitutes acceptance of the updated Terms.

What Wheelie Hungry Is

Wheelie Hungry is a directory and locator tool designed to help individuals discover food trucks and ice cream trucks in real time, and to enable truck owners to share location, menu, and updates with customers.

The Service functions solely as a directory and locator. The Service does not process food orders, does not facilitate in-app payments, and does not act as an intermediary in transactions. All purchases occur directly between customers and truck operators.

Accounts

An account is required to access certain features of the Service.

• Consumer accounts: Accounts created by individuals utilizing the Service to locate, track, and engage with food trucks.
• Business accounts: Accounts created by truck operators or vendors to establish and manage a truck listing.

Both consumer and business account holders are responsible for maintaining the security of login credentials and for all activity conducted under their account.

Business Accounts & Subscriptions

Business accounts may operate under a Free plan or upgrade to a paid Growth plan for access to additional features. Paid subscriptions are billed through Stripe on a recurring basis until canceled. Cancellation may occur at any time; the selected plan remains active through the end of the period already paid for. Subscription pricing or features may be modified with reasonable notice.

Business account holders are responsible for the accuracy of all information posted through the Service, including location, menu, hours, photos, and announcements. False or misleading location information, impersonation of another business, or use of the Service for unlawful purposes is prohibited.

Consumer Accounts & Subscriptions

Consumer accounts provide access to features that allow individuals to locate, track, and engage with food trucks and ice cream trucks through the Service.

Consumer accounts operate under a Free plan. Premium subscription options may be introduced in the future to provide additional features. Any paid subscriptions will be billed on a recurring basis until canceled. Cancellation may occur at any time; the selected plan remains active through the end of the period already paid for. Subscription pricing or features may be modified with reasonable notice.

Consumer account holders are responsible for maintaining the accuracy of account information and for all activity conducted under the account. Misuse of the Service, including false or misleading information, impersonation, or unlawful activity, is prohibited.

Acceptable Use

The Service must be used in compliance with applicable laws and these Terms. The following activities are prohibited for all account holders:

• Unlawful use: Using the Service for any unlawful purpose.
• Service disruption: Attempting to interfere with or disrupt the normal operation of the Service.
• Unauthorized access: Using another person's account without permission.
• Data scraping: Scraping or harvesting data from the Service beyond normal personal use.

Additional restrictions apply to business accounts:

• False business information: Posting false, misleading, or fraudulent business or location information.
• Impersonation: Impersonating another business or misrepresenting affiliation.

Food Safety & Truck Conduct

Wheelie Hungry does not prepare, inspect, or sell food. The Service is not responsible for the quality, safety, legality, or availability of food sold by any truck listed on the platform, nor for any transaction, interaction, or dispute between consumers and truck operators.

Food trucks listed on the Service are independently owned and operated businesses. They are not agents, representatives, or employees of Wheelie Hungry, LLC.

Content Provided by Business

Business account holders retain ownership of the content they post through the Service, including truck photos, descriptions, announcements, and menu items. By posting such content, business account holders grant Wheelie Hungry, LLC a non-exclusive, worldwide, royalty-free license to display, distribute, and otherwise use the content within the Service.

Business account holders are responsible for ensuring that they have the necessary rights to any content uploaded. Posting content without appropriate rights, or content that infringes upon the intellectual property of others, is prohibited.

Termination

Accounts may be discontinued at any time by the account holder through cessation of use or deletion of the account. Wheelie Hungry, LLC may suspend or terminate accounts that violate these Terms or that are reasonably believed to pose a risk to the Service, other users, or the integrity of the platform.

Suspension or termination may result in loss of access to the Service and removal of associated content.

Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind, whether express or implied. No guarantee is made that truck locations, hours, or menus displayed within the Service are accurate or current, as this information is provided directly by independent truck operators.

To the fullest extent permitted by law, Wheelie Hungry, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service, including but not limited to loss of data, loss of profits, or business interruption.

Changes to These Terms

Wheelie Hungry, LLC may update these Terms from time to time. In the event of material changes, the "Last updated" date at the top of this page will be revised. Continued use of the Service after such changes constitutes acceptance of the updated Terms by both consumer and business account holders.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.
